If you are facing emergency bankruptcy, it is likely that you would be better off filing for Chapter 7. However, many bankruptcy firms encourage clients to file for Chapter 13 — especially if they don't pass the means test for easy access to Chapter 7 bankruptcy. You should know that Chapter 13 may not be in your best interest — and it is not your only option.
Just because you did not pass the Chapter 7 means test does not mean you are ineligible to file for Chapter 7. All it means is that the bankruptcy court will scrutinize your expenses. If your current lawyer does not provide this alternative to filing for a standard Chapter 7, I am happy to provide a second opinion.
